Do You Need a Permit for a Gazebo?

There are a few factors that will require you to get a permit, including the gazebo’s size, location, and whether you are adding electricity. Different Delaware municipalities can require different permitting regulations. Below, we have detailed aspects that will determine if you need a permit for a gazebo. 

What are Gazebos?

Gazebos are open-sided, closed-roof structures that are a focal point for any home’s outdoor living space. They are often seen in gardens, local parks, and a homeowner’s backyard. These structures provide an area for additional seating or an outdoor dining table that will be completely protected from Delaware weather elements. You can even add screens to the open sides to continue to allow air circulation, but prevent pests from getting inside. Factors Determining if You Need a Gazebo Permit

The most important deciding factor for whether you’ll need a permit for a gazebo is the structure’s size. Larger gazebos will generally need a building permit to begin construction. In our experience, gazebos over 100 square feet and taller than 10 feet will need a permit. However, some municipalities will require permits if the structure is over 150 square feet or more. We always recommend checking with your local municipal office for any required permits in your area.

Local Delaware Rules

In Kent County, DE, a permit is required for any detached structure over 300 square feet. New Castle County, DE, exempts gazebos from needing a permit if it is under 200 square feet and under 20 feet tall. In Sussex County, DE, permits are required for any accessory structure built on a property, which includes gazebos. 

Location

If you want your gazebo to be attached to your house, some municipalities will consider that an addition. Generally, a home addition will require a building permit. When building a gazebo not attached to your house, the structure must be 10-15 feet away from the house or other structures. If you want to build a gazebo on public land, like at a park, then you may need to obtain additional permits from the local government. 

Zoning Laws 

When deciding the best location for your new gazebo, you’ll have to remember the area’s zoning laws you need to adhere to. In our experience, if you don’t need a building permit, you’ll be required to get a zoning permit. This will verify that you are complying with local zoning laws. The most important zoning law you have to comply with is that the structure must be built at least 5-10 feet away from any property lines. In a few Delaware municipalities, a gazebo is considered an accessory structure, which will require a building permit to ensure they are compliant with local building codes. 

Adding Utilities 

If you are running electricity lines to your gazebo, you will need to acquire electrical permits. We recommend having a professional install any electricity for your gazebo. In Delaware, a State of Delaware licensed electrician is required to have all electrical work inspected by a licensed agency. If you want to run water to the gazebo for an outdoor kitchen, you’ll also have to obtain a plumbing permit. These permits are needed to ensure that the electricity and plumbing are installed properly and up to code to ensure they are safe to use.
